In accordance with N.C. Gen. Stat. § 150B-21.3A and 26 NCAC 05 .0207, the North Carolina Board of Funeral Service hereby provides you with notice that it has voted on the below (SEE LINK BELOW) initial determinations of its rules for purposes of completing the mandatory periodic review at the NC Rules Review Commission.  Accordingly, the Board will be accepting public comment on the initial rule designations until the close of business on Friday, April 21, 2017.  If you wish to submit public comment about any of the proposed rule classifications, you may do so by either mailing a public comment to the attention of the Board’s Rulemaking Coordinator, Christina Cress, by US Postal Service or other delivery service to 1033 Wade Avenue, Suite 108, Raleigh, NC 27605, or by e-mail to  The definition of “public comment” as provided by N.C. Gen. Stat. § 150B-21.3A(a)(5) is as follows:  “Public comment. - Means written comments objecting to the rule, in whole or in part, received by an agency from any member of the public, including an association or other organization representing the regulated community or other members of the public.”  “Public comment” is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule. Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).

NCBFS Endorses Proposed Bill

Our appreciation goes out to those who participated in what appeared to be a productive day. Following multiple public comments sessions, the Board voted during the February 2017 Board Meeting to revise and approve the proposed Bill which can be found below:

Pursuant to 26 NCAC 05 .0205, the North Carolina Board of Funeral Service (hereinafter the “Board”) voted at its meeting on January 11, 2017 to request that its report be rescheduled for an earlier review by the North Carolina Rules Review Commission in advance of the date currently set forth in 26 NCAC 05 .0211.  Please see the pertinent information below.  The Rules Review Commission will consider this request at its February 16, 2017 meeting.  You may contact the Rules Review Commission to object to the rescheduling by e-mail at or by mail at Office of Administrative Hearings, 6714 Mail Service Center, Raleigh NC 27699-6700.

WARNING:   If Board staff does not receive your completed license renewal application and fee by 5:00 p.m. on Wednesday, February 1, 2017, you will immediately be deemed to have forfeited and surrendered your license.  This means that you will not be authorized to conduct any funeral activity for which a license is required.  There will be no opportunity to reinstate your forfeited license absent a formal hearing before the Board.
